Terms of Service
The terms for using NextQom: our website, the NextQom platform and the services we provide to businesses.
1. Who we are
NextQom is operated by NextGroup Investment Limited, a private limited company registered in England and Wales under company number 17450986. Registered office: 11 Coniston Road, Blackburn, England, BB1 5PU. E-mail: [email protected].
These terms are an agreement between NextGroup Investment Limited ("NextQom", "we", "us") and the business that uses NextQom ("you").
2. About these terms
These terms apply to the NextQom platform and our services (the Service) and to the use of nextqom.com. A business agrees to them by signing an offer or order with us, or by using the Service. Where a signed offer, order or other written agreement with you says something different, it applies instead of these terms.
The Service is for businesses. By accepting these terms you confirm that you use the Service for your business, and that the person accepting them may bind the business.
3. The Service
NextQom is a CRM platform for businesses. Each business gets its own CRM (for example clients and leads, sales, calendar and bookings, tasks, quotes and invoices, documents and an Inbox, depending on its plan and modules), a client portal for its own clients and, where included, a website we host, together with services such as setup, SEO and Google Ads management. What your plan includes is described in your offer, your order or our price list.
AI features draft and suggest. Check their output before you rely on it or send it.
4. Accounts and access
- There is no public sign-up: a business's account is created by NextQom or one of our partners and handed over to the business's owner.
- You decide who on your team has access and with which role, within your plan.
- Keep sign-in details private, and tell us at once at [email protected] if you think an account is being misused. You are responsible for what is done through your accounts.
5. Acceptable use
Do not use the Service to break the law or help others break it; to send spam or messages people have not agreed to receive; to infringe anyone's rights; to upload malicious code or unlawful content; to try to reach another business's data or test our security without our written permission; or to overload or disrupt the Service. We may suspend an account that does (see Ending and suspension).
WhatsApp and other connected services
If you connect WhatsApp, you must also follow Meta's terms and policies for it, including the WhatsApp Business Terms of Service, the WhatsApp Business Messaging Policy and the WhatsApp Commerce Policy. In particular, message only people who wrote to you or have given you permission to contact them on WhatsApp, use message templates Meta has approved to start or resume a conversation outside the 24-hour customer service window, and stop when someone asks you to.
Meta decides on your WhatsApp Business Account, phone number, display name and templates, and may limit or end them; we are not responsible for Meta's decisions or for the availability of WhatsApp. The same applies to Google, Microsoft and the other providers you connect: their terms govern your use of their services.
6. Using our website
Anyone can use nextqom.com to learn about NextQom and book a demo: with the form, by calling our AI receptionist, or through Ask Qom AI. The assistants are AI: they can make mistakes, and nothing they say is an offer or a promise. Prices on the website are per month and exclude VAT unless stated. Use the forms and the call only for real enquiries, and do not try to get around their limits. How we handle what you send us is in our Privacy Policy.
7. Your data, and our role as processor
- You own the data you and your users put into the Service (Customer Data). We use it only to provide and support the Service, on your instructions.
- For the personal data in Customer Data, you are the controller and we are your processor. Our data processing agreement (DPA) applies to that processing and forms part of these terms; ask us at [email protected] for a copy. The service providers we use for it are named in our Privacy Policy.
- You are responsible for having a lawful basis to collect and use Customer Data, for telling the people concerned, and for what you and your users put into or send through the Service.
- Where we are the controller, for example of your account and billing details, our Privacy Policy applies.
8. Fees and payment
- The fees, the billing period and what a plan includes are those in your offer or order or, if there is none, in our price list when you choose the plan.
- Fees are billed in advance for each billing period, by card through Stripe or by invoice. They exclude VAT and other taxes, which are added where the law requires.
- A free trial, when offered, lasts for the period stated in the offer or on our website.
- If a payment is late, we may suspend the Service after telling you, until it is paid.
- We may change our prices for future billing periods. We tell you by e-mail before a new price applies to you, and you can cancel before it does.
9. Availability and changes to the Service
We work to keep the Service available, secure and backed up, but we do not promise that it will be uninterrupted or free of errors. It may be unavailable, for example during maintenance or when a provider we depend on fails. We improve the Service over time and may change or remove features; we tell you in advance about a change that materially reduces what you pay for.
10. Intellectual property
- NextQom and its software, including the code of the CRM and of the websites we host, its designs and its documentation, belong to us or our licensors. While your subscription runs, we give you a non-exclusive, non-transferable right to use the Service for your business.
- Your content (texts, logos, photos and Customer Data) stays yours. You give us the right to use it to provide the Service, for example to show it on the website we host for you.
- Ideas and feedback you give us about the Service may be used by us freely.
11. Liability
- Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded by law.
- Subject to that, neither party is liable to the other for any loss of profit, revenue, business, goodwill or anticipated savings, or for any indirect or consequential loss.
- Subject to that, our total liability arising out of or in connection with these terms, in contract, tort (including negligence) or otherwise, is limited to the fees you paid us for the Service in the 12 months before the event that gave rise to the claim.
- Except as these terms say, the Service is provided without other warranties or conditions, to the extent the law allows.
- Neither party is liable for a delay or failure caused by events beyond its reasonable control.
12. Ending and suspension
- You can cancel at the end of a billing period by writing to [email protected] from the owner's e-mail address.
- We may suspend or end the Service if you do not pay, if you seriously or repeatedly break these terms, to stop a security incident, or to comply with the law. Unless security or the law prevents it, we tell you first.
- When the Service ends, your account becomes read-only, you can ask for an export of your data (a database export and an archive of your files), and we then delete your business and its data after a 30-day grace period, as described in our Privacy Policy.
13. Governing law
These terms, and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes or claims), are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
14. General
These terms, your offer or order and the DPA are the whole agreement between us about the Service. If a court finds part of these terms invalid, the rest stays in force. We may transfer these terms to a company that takes over NextQom; you need our written agreement to transfer yours.
15. Changes to these terms
We may update these terms. The date at the top shows the latest version. We tell the businesses that use NextQom about important changes by e-mail before they take effect; if you do not agree, you can cancel before they apply to you.
